1. Acceptance of Terms
By engaging the services of Draft Constructive Design ("we", "us", "our"), accessing our website at www.draftconstructive.com, or submitting an enquiry, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services or website.
2. Services
Draft Constructive Design provides architectural design, Vastu planning, 2D/3D visualization, interior design, technical drawings, and building construction services. The specific scope, deliverables, timeline, and fees for each project are agreed upon in a separate written proposal or contract before work commences.
3. Project Proposals & Agreements
All projects begin with a written proposal or agreement outlining the scope of work, deliverables, timeline, payment schedule, and fees. Work will not commence until the proposal is accepted and the agreed initial payment is received. Any changes to the agreed scope must be documented in writing and may result in revised fees and timelines.
4. Fees & Payment
Fees are as agreed in the project proposal. Payments are milestone-based unless otherwise agreed. Invoices are due within 7 days of issue unless stated otherwise. Late payments may result in work being paused until the outstanding amount is settled. All fees are exclusive of applicable taxes unless stated otherwise.
5. Intellectual Property
All designs, drawings, renders, and documents created by Draft Constructive Design remain our intellectual property until full payment is received. Upon receipt of full payment, the client receives a licence to use the deliverables for the specific project described in the agreement. Designs may not be reproduced, modified, or used for other projects without our written consent.
6. Client Responsibilities
The client is responsible for: providing accurate site information, dimensions, and requirements; obtaining necessary land ownership documents and permissions; ensuring site access for surveys and supervision visits; reviewing and approving designs within agreed timeframes. Delays caused by the client may affect project timelines and may incur additional charges.
7. Revisions
The number of revision rounds included in each service is as stated in the project proposal. Additional revisions beyond the agreed number will be charged at our standard revision rate, which will be communicated before work proceeds.
8. Construction Services
For building construction projects, a separate construction contract will be provided detailing scope, materials, timeline, payment schedule, and warranty terms. All construction work is carried out in accordance with applicable Indian building codes and standards.
9. Limitation of Liability
Draft Constructive Design's liability for any claim arising from our services is limited to the fees paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental losses. We are not responsible for delays or failures caused by circumstances beyond our reasonable control.
10. Confidentiality
We treat all client project information, documents, and personal data as confidential. We will not share your project details with third parties without your consent, except as required to deliver the agreed services (e.g., contractors, structural engineers).
11. Termination
Either party may terminate a project agreement with written notice. In the event of termination, the client is liable for payment of all work completed up to the termination date. Deposits and milestone payments already made are non-refundable unless otherwise agreed in writing.
12. Governing Law
These Terms and Conditions are governed by the laws of India. Any disputes arising from our services or these terms shall be subject to the jurisdiction of the courts of Ranchi, Jharkhand.
13. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. The current version will always be available on our website. Continued use of our services after changes constitutes acceptance of the updated terms.
